kickassproductsp operates strictly as a specialized digital interior design studio, serving residential and commercial clients located exclusively in Europe.

2. Scope of Service & Pure Digital Deliverables

• Digital & Customized Deliverables: All services provided by kickassproductsp consist exclusively of digital spatial plans, 3D architectural renders, mood boards, color scheme guidelines, or virtual design consultations tailored precisely to customer-provided floor plans and specifications.
• No Physical Inventory: We do not sell, store, pack, or ship physical goods, tangible furniture, or physical materials. Consequently, no physical freight tracking numbers or physical logistics shipping documents are generated for orders. All deliverables are transmitted electronically via secure email or cloud download links.

3. Order Structure, Pricing & Delivery Timelines

• One-Time Service Charges: All design packages and custom project fees are non-recurring, one-time charges. We do not charge automatic subscriptions, recurring memberships, or hidden transaction fees.
• Service Package Fees: Initial checkout fees cover defined initial service scopes (e.g., preliminary room layout drafting, 3D visual concepts, or spatial consultations).
• Bespoke Scope Proposals: For complex multi-room or commercial projects requiring extended rendering, formal itemized project proposals are issued via email (decoration@kickassproductsp.com) and mutually agreed upon before secondary production stages begin.
• Standard Delivery Timeline: Digital design initial concepts are typically transmitted within 3 to 7 business days following receipt of complete floor plans and client specifications, unless a custom timeframe is explicitly agreed upon in writing.

4. EU Consumer Right of Withdrawal & Immediate Service Execution Notice

This section applies to European Union (EU) and European Economic Area (EEA) consumers pursuant to the EU Consumer Rights Directive 2011/83/EU governing custom-made content and digital service contracts:

• Exclusion for Bespoke Services: Pursuant to Article 16(c) of EU Directive 2011/83/EU, the standard 14-day statutory right of withdrawal does not apply to contracts for the supply of goods or services made to the consumer’s specifications or clearly personalized.
• Immediate Execution Request: By placing an order and submitting your spatial specifications, you explicitly request and consent to the immediate commencement of customized design performance prior to the expiration of any statutory cancellation window.
• Acknowledgement of Waiver: You expressly acknowledge that once individual design work or digital rendering has commenced upon your explicit request, you waive and forfeit your statutory 14-day right of withdrawal for personalized digital deliverables.

5. Refund, Revision & Dispute Resolution

• Pre-Production Cancellations: If you request a order cancellation in writing before our design team has initiated initial drafting or rendering (within 12 hours of purchase), a full refund will be issued to your original payment card.
• Revisions & Quality Assurance: Because our deliverables are non-tangible digital design works tailored to specific dimensions, orders are generally non-refundable once initial drafting files or renders have been delivered. However, each standard package includes up to two (2) rounds of visual revisions to ensure design alignment with your submitted brief.
• Non-Delivery or Technical Issues: If you experience technical difficulties receiving or downloading your digital deliverables, or if an order is not delivered within the promised timeframe, please contact us immediately at decoration@kickassproductsp.com. Valid non-delivery inquiries will be resolved within 24 hours via file re-transmission or appropriate compensation.

6. Payment Processing via Stripe

All transactions processed on www.kickassproductsp.com are secured via our payment processing partner, Stripe, Inc.

• Payment credentials are encrypted end-to-end and handled in strict compliance with Payment Card Industry Data Security Standards (PCI-DSS Level 1).
• By initiating a payment, you represent and warrant that you are legally authorized to use the designated payment card or method for the specified transaction amount.

7. Intellectual Property & Digital Usage License

• Original & Licensed Assets: All visual renders, 3D assets, design layouts, and photography featured on our platform are either original creations owned by KICKASS PRODUCTS PTY LTD or commercial stock assets fully licensed for business representation.
• Client Usage License: Upon final settlement of service fees and electronic delivery, clients receive a non-exclusive, perpetual, personal license to use the custom digital design plans and 3D renders for their designated residential or commercial property execution. Commercial reselling or redistribution of our raw digital files is prohibited.

8. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without prejudice to mandatory protective consumer regulations applicable under European Union law for EU-based consumers.
